Q: After the migrant worker has been assigned to the position as intermediate skilled workers, but this worker remains at large, should the vacancy left behind be subject to control in the afterward?


Answer:


No. There is no enrollment quota for intermediate skilled workers, so if a worker goes missing or their whereabouts are unknown after their employment permit is canceled and the number of intermediate skilled workers hired by an employer is under the upper limit, an immediate replacement application can be filed with no time limit. However, the provisions of Subparagraph 3, Paragraph 1, Article 54 of the Employment Service Act still apply to employers of intermediate skilled workers and if the number or proportion of foreign workers out of contact exceeds regulations applications will not be approved. In other words, employers should still manage their foreign workers to the best of their ability to avoid intermediate skilled workers falling out of contact.
