Labor Contract > I. Labor Contract Verification


◎An employer who employs intermediate skilled workers must, in accordance with regulations, execute a written labor contract. The labor contract must specify the employment commencement date and be consensually signed by both the employer and the worker. The period of validity of the contract must comply with Article 52 of the Employment Service Act, with the term of employment may be agreed upon for a maximum of 3 years.
◎The contents of the labor contract must be consensually agreed upon by the employer and the worker and should not violate any laws or regulations. The standard labor contract content, aside from the period of validity, includes work duties, workplace, salary, board and lodging, working hours, leave, breaks, and annual leave, in order to clarify the rights and obligations of both the employer and the worker.
◎Intermediate skilled workers with prior work or study experience in Taiwan, who are familiar with relevant regulations, to accelerate the resolution of talent shortages, in accordance with Article 45 of the Regulations on the Permission and Administration of the Employment of Foreign Workers, to simplify the application process, intermediate skilled workers applying for an entry visa are no longer required to submit a Foreign Worker's Affidavit for Salary and Expenses Incurred, certified by the relevant authority of their home country. The labor contract verification process should be handled according to the requirements of the Taiwanese representative office in the worker's home country.
