Contract Extension and Termination > IV. Contract Termination Verification


According to Article 3 of "Verification Procedure for Employers Terminating Employment Relationships with Type B and Type C Foreign Workers" issued by the Ministry of Labor, if the employer and intermediate skilled foreign worker terminate the employment permit before the expiry date, they must have the local competent authority verify and ascertain the intermediate skilled worker's true intentions 14 days prior to their consensual termination. 

Exemptions from the verification procedure
1. Scheduled to leave Taiwan within 14 days before the expiration of the employment permit.
2. The intermediate skilled foreign worker failure to pass the health examination.
3. The employment permit is terminated, or the application is rejected, and the foreign worker is ordered to leave due to a violation of the regulations under the Employment Service Act.
4. The foreign worker is ordered to leave the country within a specified period by judicial authorities, the central competent authority, the health authority, police, or immigration authorities.

 

Processing Unit: Labor bureaus or labor departments of the municipal or county (city) government where the intermediate skilled worker's workplace is.
