Confirmation of Employer (Applicant) Eligibility
·Employer’s Application Eligibility:
1. For the domestic employment of graduated foreign students or overseas compatriot students: Obtain a tourist hotel business license, or a hotel or homestay registration certificate, issued by the competent authority responsible for the relevant sector.
2. For overseas employment of foreign skilled workers, for domestically employed foreign skilled workers, the transfer upon employment permit expiration, the continuation of contracts, or the extension of employment permit: Obtain a tourist hotel business license, or a hotel registration certificate issued by the competent authority responsible for the relevant sector.
·Employer Application Quota:
1. For the domestic employment of graduated foreign students or overseas compatriot students, the total number of skilled workers shall not exceed 30% of the employer’s average number of workers over the one-year period ending two months prior to the application date.
2. For overseas employment of foreign skilled workers, for domestically employed foreign skilled workers, the transfer upon employment permit expiration, the continuation of contracts, or the extension of employment permit, employers must first increase the salaries of local workers. Each salary increase for one local worker grants the quota of one foreign skilled worker, and the increase must apply to the lowest-paid full-time local workers. The total foreign skilled worker quota obtained through this method shall not exceed 10% of the employer’s average workers during the one-year period ending two months before the application date.
※Salary Adjustment Method:
(1) Increase salary by NT$2,000, and raise the insured salary under Labor Insurance or Labor Occupational Accident Insurance grade up by at least one level.
(2) Increase salary by NT$2,000, if the insured salary grade under Labor Insurance or Labor Occupational Accident Insurance is Level 1, must be raised to at least Level 3.
In summary, the total number of domestically employed graduated foreign students or overseas compatriot students, foreign skilled workers overseas employed, or domestically employed foreign skilled workers transfer upon employment permit expiration, the continuation of contracts, or the extension of employment permit, shall not exceed 30% of the average workers employed in the one-year period ending two months prior to the month of application.
